Terms and Conditions

Through the getMail service Edentiti provides organisations with the tools to create, send and manage legitimate email campaigns.

By clicking the "I accept the terms and conditions" box on the Sign Up page you accept these terms and conditions.

This service may not be used to send unsolicited emails (Spam). Edentiti has a zero tolerance policy and we adhere to the rules of the Australian Spam Act 2003.

1. Services

1.1 The edentiti getMail services are provided subject to this agreement. By posting new versions of this agreement at the getMail.com.au website we may modify the terms of this agreement and discontinue or revise any or all other aspects of the service at its sole discretion. All such changes will become effective upon posting of the revised terms.

1.2 When you sign up for an edentiti getMail account you receive 100 free email credits. Any further use of the service requires the prepayment of blocks of email credits. The minimum purchase is $22 which allows the user to send out 200 emails via the edentiti getMail service. Edentiti getMail has a volume based sliding scale pricing structure.

1.3 The pricing schedule is subject to change at any time.

1.4 All fees paid to edentiti getMail are non-refundable unless the account is terminated by getMail for any reason other than violation of Australian anti-spam laws.

1.5 Payment will be made by a valid credit card unless other payment arrangements have been made in advance.

1.6 edentiti getMail service is only available to Australian organisations.

1.7 You must complete the registration form on the sign-up page to use the edentiti getMail service. After submitting your registration details edentiti getMail will send you a welcome email which includes a link you must click on to activate your account.

1.8 As part of the sign-up process you will provide an email address and password for your edentiti getMail account. You are responsible for maintaining the security of your account, passwords, files and any use of your edentiti getMail account in your name.

1.9 edentiti getMail reserves the right to refuse registration, or cancel accounts if they are deemed to be inappropriate.

2.0 edentiti getMail makes no guarantee that HTML messages will be rendered properly on all recipients email programs. Edentiti getMail provides a built-in HTML editor which you can use to compose your message. Edentiti getMail makes no guarantee that the the HTML generated by this HTML editor will result in messages that look the same in all email platforms.

2. Bounced emails.

Edentiti getMail will make every attempt to deliver your emails. Each publisher can monitor all bounced and returned emails. Depending on the reason for the bounce edentiti getMail can be used to send undelivered email to an alternate email address. Other options we can utilise include fax and sms. Edentiti getMail may request additional information from the publisher in order to follow up on bounced emails.

3. Beacons.

Each email sent via the edentiti getMail system includes a web beacon which assists in bounce management and reporting.

4. Use of edentiti getMail and IPR

Edentiti grants registered getMail publishers a non-exclusive right to use the services pursuant to these terms and conditions. Edentiti owns all getMail intellectual property rights.

5. Indemnity

You indemnify us and our related corporate bodies and our respective employees against all actions, claims and demands (including the cost of defending or settling any action, claim or demand) on a full indemnity basis which may be instituted against us following a failure by you (or any person using your account log in information, with or without your authorisation) to comply with these terms and conditions.

6. General

1.1 These terms and conditions are governed by the laws of the Australian Capital Territory.

1.2 We do not accept responsibility for any loss or damage (including through negligence) which you may directly or indirectly suffer in relation to your use of your getMail account.

1.3 We make no warranty that services provided by this website will meet your requirements.

1.4 If any of these terms and conditions are held to be invalid, unenforceable or illegal for any reason the remaining terms will remain in force.
